Supervisor: Riverhead Resorts' Contract is Dead if it Doesn't Wire $3.9 Million by Friday

Riverhead Town Supervisor Sean Walter said Tuesday he's had enough of Riverhead Resorts' "shenanigans" and wants to end the contract the company has had with the town since 2007 to purchase 755 acres at Enterprise Park at Calverton.

He said that if Riverhead Resorts doesn't arrange to have $3.9 million in overdue payments wired into a local escrow account by 9:30 Friday morning – which he doubts will happen – then he will call a special Town Board meeting for that day to vote on a resolution terminating the contract.

"And then they're done," Walter said. "I don't even want to hear from them again."

Riverhead Resorts had previously been given until Tuesday, Nov. 16 – the date of the next regularly scheduled Town Board Meeting – to have the funds available. But, Walter said, recent events, including the that had already been delivered to the town, had tested his patience to the limits.

"I don't want to let it fester any longer, neither does the rest of the Town Board," Walter said. "Short of $3.9 million being delivered to us by 9:30 on Friday, we can move on with the next phase of EPCAL history."

Barclays had issued the stop order on Friday after a close-up photo of the check, taken during a photo-op last week, showed up on the internet.

According to Morton Weber, Riverhead Resorts' lawyer, Barclays claimed that its security had been breached because its codes and those of its customer, Solutio Finance Limited, could be made out in the photo.

Weber said Monday that Barclays told him that it would take three to five days to set up a new account, but that after it was set up, the $3.9 million would be wired into the escrow account of Frank Isler, the outside attorney representing the town.

"That's absurd," Walter said Tuesday. "Who believes that?  If your account gets locked up, you should be able to move your money out of that account and put it in another account right away and wire it to us.

"I'm done, Walter said. "I don't have time for their song and dance."
